Terms of Use

The agreement between you and nOxyApp: what the platform is for, what you may expect from it, what we expect from you — and what happens to competition data, which is the heart of the service.

1Who we are and what this is

nOxyApp is a competition-management platform for freediving — registration, startlists, judging, live coverage, records, and results — operated by nOxygen Apnea Club Kft. (company reg. no. 01-09-419251), 1037 Budapest, Flóra utca 7. fszt. 1., Hungary ("we"). These Terms govern every use of nOxyApp. By creating an account, or by entering or helping to run a competition on the platform, you accept them.

2Eligibility and your account

3The licence we give you

We grant you a personal, non-exclusive, non-transferable right to use nOxyApp for participating in, organizing, and following freediving competitions. We retain all rights in the software, design, and branding. You may not resell access, scrape the platform at scale, reverse-engineer it, or use it to build a competing dataset. Public pages (startlists, results, live datastream) may be linked and quoted freely with attribution.

6Athletes: safety and truthfulness

Freediving is a sport with real physiological risk. nOxyApp is an administrative tool: the safety of a competition is the responsibility of its organizer and its safety team, governed by the applicable federation rules. You declare performances honestly, follow the organizer's and judges' instructions, and — where the competition requires it — submit a genuine medical certificate.

7Organizers: your responsibilities

If you run a competition on nOxyApp you are responsible for: the lawfulness and safety of the event itself; the accuracy of its configuration (sessions, rules, fees); reviewing medical documents and waivers you require; and any custom questions you add to your entry waiver — for those questions you determine the purpose of the data collected, and you must have a lawful basis for them. Use the data of your competition's entrants only for running that competition.

8Payments

Competition fees are set by organizers and processed by Stripe; your card details go to Stripe, not to us. Fees, refund conditions, and what a fee covers are the organizer's terms, shown at registration. Where we facilitate payment collection we do so as the organizer's technical service provider; where the platform charges a service fee it is shown transparently in the fee breakdown at checkout.

9Availability and changes

We work to keep nOxyApp reliable during competitions, but we provide it as is: we do not guarantee uninterrupted availability, and features may change as the platform evolves. We may perform maintenance, and we announce material feature removals to affected organizers in reasonable time.

10Liability

To the extent permitted by law: we are not liable for the conduct or safety of competitions, for decisions of judges or organizers, for indirect or consequential damages, or for loss of data you failed to keep copies of where the platform offers exports. Nothing in these Terms limits liability that cannot lawfully be limited (including for intent or gross negligence, or personal injury caused by us). Our total liability toward you is capped at the total fees you paid through the platform in the twelve months preceding the claim, or EUR 100 if you paid none.

11Ending the relationship

You can ask us to delete your account at any time by writing to hello@noxygen.hu; we honour such requests without undue delay. The Privacy Notice describes exactly what is removed and what remains (the permanent competition record, and records we must keep by law). Sections of these Terms that by nature survive — the permanent record, liability, governing law — survive account closure.

12Changes to these Terms

When these Terms materially change we publish the new version, raise its version number, and ask you to review and accept it the next time you sign in. If you do not accept, you may close your account; continued use after acceptance means the new version applies.

13Governing law and disputes

These Terms are governed by the law of Hungary. Disputes belong to the courts of Budapest, Hungary, without prejudice to mandatory consumer-protection rules of your country of residence that give you a more favourable forum. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform.
